IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.

  2. Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of Japan

12.3 Class Action Waiver

Any proceedings to resolve disputes will be conducted on an individual basis. You waive any right to participate in class actions or class-wide arbitration.

13.6 Headings

Section headings are for convenience only and shall not affect the interpretation of these Terms.

13.7 No Partnership

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Hidden Beaches Japan.

14. Travel Safety and Responsibility

By using our travel information, you acknowledge and accept that:

  • Travel inherently involves risks, including but not limited to accidents, injury, illness, property damage, and death
  • You are solely responsible for your safety and well-being during travel
  • You should obtain comprehensive travel insurance before traveling
  • You must comply with all local laws, regulations, and customs
  • You should assess your physical fitness and capabilities before undertaking activities
  • Environmental conditions (weather, tides, currents, etc.) can be unpredictable and dangerous
  • We are not responsible for the actions or omissions of third-party service providers
